HB 141 Update

DCNP Members,

       The 2021 Legislative Session continues to be one of the busiest in recent years, specifically regarding NP practice. The most recent and upcoming Bill, House Bill 141: An Act to Ament Title 24 of the Delaware Code Relating to Advanced Practice Registered Nurses, is expected to be introduced to the Sunset Committee this Wednesday, April 28th 2021 at 3:00PM.

       HB 141 is meant to be a companion bill to the recent HB 21 regarding the APRN Compact. Previously DCNP has expressed concern regarding several disparities in HB 21 regarding transition to practice hours, lack of controlled substance prescriptive authority, and lack of congruency with the current Delaware NP regulations. The newly proposed HB 141 appears to address some of these concerns, specifically, the concern for lack of congruency with the APRN compact and current Delaware NP regulations.

                Several key components introduced in HB 141 include:

  • The removal of the need for a collaborative agreement for licensure purposes.
  • Clarification of “APRN” and “full practice authority” definitions to align with national standards and removes the term “independent practice”
  • Granting full practice authority with licensure
  • A recomposed APRN governing committee to include 9 APRNs
  • Removal of the current process for granting Independent Practice

       The DCNP has extensively reviewed HB 141 and after much consideration has voted in support of HB 141. DCNP will continue to align with other professional nursing organizations throughout the state and legislative officials as well as the State of Delaware in hopes to continue to move HB 141 forward in a positive direction. In the upcoming weeks it is expected this bill will be introduced into committee and if approved, thereafter, will move forward alongside of HB 21 to the House. 

      If you have the opportunity there are two additional opportunities to attend the town halls discussing HB 141; tomorrow April 27th at 7:15AM and 5:00PM. Additionally if you have not taken the opportunity to reach out to your respective legislators expressing support for HB 141 please take one last opportunity to advocate for NP practice in Delaware.
